CLUB C41 TERMS OF SERVICE Last Updated: April 14, 2026

1. ACCEPTANCE OF TERMS By breaking the seal on the Club C41 camera packaging, or by registering your Camera ID via our digital portal, you agree to be bound by these Terms of Service. This agreement is between you and Club C41, LLC ("Club C41", "we", "us", or "our"). If you do not agree to these terms, do not open the packaging. Unopened, sealed cameras may be subject to the return policy of the specific vendor or venue where purchased. Once the physical packaging is opened, all sales are final.

2. THE NATURE OF ANALOG PHOTOGRAPHY You acknowledge that analog film photography and chemical development are physical, volatile processes. While Club C41 utilizes professional-grade development standards, the inherent nature of film means results are never guaranteed. Variations in lighting, user error, mechanical camera failure, or chemical processing anomalies may result in blank, distorted, or damaged images.

3. LIMITATION OF LIABILITY In the unlikely event that your film is lost, stolen, damaged, or destroyed during the drop-box retrieval, transportation, or chemical development process, Club C41’s sole liability, and your exclusive remedy, is strictly limited to a refund of the retail purchase price of the camera. Under no circumstances shall Club C41, its venue partners, or corporate sponsors be held liable for any indirect, incidental, emotional, or consequential damages arising from lost, unrecoverable, or damaged photographs. We are providing a physical product and a chemical service; we cannot insure the sentimental value of your images.

4. DIGITAL DELIVERY & STORAGE Club C41 will deliver high-resolution digital scans to the email address provided during registration. It is your responsibility to ensure the email provided is accurate. We will host your digital files for a maximum of [Insert Number, e.g., 30] days from the date of delivery. You are solely responsible for downloading and backing up your images within this window. After this period, files may be permanently deleted from our servers.

5. MEDIA RELEASE & PRIVACY If you opted "YES" to social sharing during registration, you grant Club C41 and its venue/event partners a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your developed images for promotional and marketing purposes across digital and physical channels. 6. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
